Terms and Conditions

1. General

These Terms and Conditions apply to all bookings made with Unforgettable AS, a Norwegian limited company (AS) offering curated tours and experiences. By booking a tour or experience, you accept these Terms and Conditions.

2. Booking and Payment

  • A non-refundable deposit of 40% of the total tour price is required upon booking to secure your place.

  • The remaining balance must be paid no later than 60 days before the tour departure date.

  • Payments are to be made in Norwegian Kroner (NOK).

3. Cancellations and Refunds

  • If you cancel:

    • More than 60 days before departure: You will receive a refund of the amount paid, minus the non-refundable deposit.

    • Between 30–59 days before departure: 50% of the tour cost will be refunded.

    • Less than 30 days before departure: No refund will be provided.

  • We strongly recommend travel insurance covering cancellations, illness, and delays.

4. Changes and Cancellations by the Company

  • We reserve the right to make minor changes to the itinerary due to local conditions.

  • In the event of force majeure (natural disasters, political unrest, pandemic, etc.), the company may cancel the tour. In such cases, we will refund the tour price, but are not liable for other expenses (e.g. flights, insurance).

  • The tour requires a minimum number of participants to proceed. In the event that the minimum number is not met, Unforgettable AS reserves the right to cancel the tour. In such cases, participants will receive a full refund of any payments made.

  • We reserve the right to make minor changes to the itinerary due to local conditions.

5. Included in the Tour Price

Unless otherwise stated, the tour price includes:

  • Accommodation

  • Local transportation

  • Winery visits and tastings

  • Meals as specified in the itinerary

  • Tour guide/host services

6. Not Included

The tour price does not include:

  • International flights

  • Travel insurance

  • Personal expenses

  • Meals not specified

  • Optional excursions or services

7. Travel Insurance

All participants are required to have valid travel insurance covering health, cancellation, and theft/loss of belongings.

8. Participant Responsibilities

  • Participants must be 18 years or older to consume alcohol during the tour.

  • You are responsible for ensuring you have a valid passport and any required visas.

  • You must inform us of any allergies, medical conditions, or special dietary needs before the trip.

  • Participants are responsible for arriving on time for all scheduled activities. Late arrivals may miss components of the tour without entitlement to a refund. If you miss a scheduled departure or activity, it is your responsibility to make arrangements to rejoin the group, at your own expense.

9. Health and Fitness Requirements

Some wine tours may involve walking, standing for long periods, or travel in warm climates. It is the participant’s responsibility to ensure they are physically fit to take part in the tour. We may decline participation if health or mobility poses a risk.

10. Participant Behaviour and Damages

Participants are expected to behave respectfully towards fellow travellers, local communities, and service providers. Unforgettable AS reserves the right to remove any participant from the tour, without refund, if their behaviour is disruptive, unsafe, or violates local laws or cultural norms.

Participants are liable for any damage caused by their actions to property, vehicles, or accommodations. Any costs arising from such damages must be covered directly by the participant and may be deducted from their security deposit or billed separately.

Unforgettable AS is not liable for personal injury, loss, or damage to property unless caused by negligence on our part. Third-party services (hotels, wineries, transport) are the responsibility of those providers.

12. Transfer of Booking

Participants may transfer their booking to another person up to 14 days before departure, provided that the replacement meets all participation criteria and any costs arising from the change are covered.

13. Privacy and Data Protection

We collect, store, and process personal data in accordance with the EU General Data Protection Regulation (GDPR) and applicable Norwegian data protection legislation. The personal data we collect may include, but is not limited to:

  • Full name, contact details, and date of birth

  • Passport information

  • Special dietary requirements and medical conditions (when voluntarily provided)

  • Payment and billing information

  • Emergency contact details (full name, relation, contact details)

We process your data for the purposes of booking management, fulfilling contractual obligations, customer service, and ensuring your safety and experience during the tour.

Legal Basis for Processing:

  • Contractual necessity (e.g. booking and delivering your tour)

  • Legal obligations (e.g. accounting and record-keeping)

  • Legitimate interest (e.g. improving services and safety)

  • Consent (where required, e.g. marketing or sensitive data like medical needs)

Data Sharing: We only share your data with trusted third-party service providers (e.g. hotels, transport providers, wineries) when necessary for delivering the services included in your tour. We ensure that any third parties processing data on our behalf follow GDPR-compliant procedures.

Data Retention: We retain your data only for as long as necessary to fulfill the purposes stated, or as required by law (e.g. financial regulations). Personal data used for marketing will be retained until you withdraw your consent.

Your Rights: You have the right to access, rectify, delete, restrict, or object to the processing of your personal data. You also have the right to data portability and to lodge a complaint with a supervisory authority.

Data Security: We take appropriate technical and organizational measures to protect your personal data from unauthorized access, loss, misuse, or disclosure.

14. Use of Photos and Media

By joining our tours, you agree that we may use photos or videos taken during the trip for promotional purposes, unless you notify us in writing before the tour begins.

15. Complaints and Feedback

If you have a complaint during the tour, you must inform the tour leader or contact us immediately to give us an opportunity to resolve it. Complaints made after the tour should be submitted in writing within 14 days.

16. Governing Law and Jurisdiction

These terms are governed by Norwegian law. Any disputes shall be resolved by the courts of Norway.
